Same Sex Marriage & the Best Interests of the Child

At this writing the White House is rumored to support a constitutional amendment to save traditional marriage (news sources). So, as an additional argument for same sex or sex-neutral marriage - this blogger references the current child custody laws; whch require the "Best Interests of the Child" be considered for that issue. By the current standard, single parent household or households where two adults of the same sex live together cannot automatically be barred from custody of minor children. Using that argument, the law merits further minor adjustment to accord equal protection in the same vein to parties seeking simple civil marriage. What has not hurt minor children; and which is permitted; like partnerships; cannot seriously weaken marriage when of the same sex. This further weakens the 'pro-creation' forces argument of hetersexual marriage only. |
